The data processed when you use this website consists primarily of so-called log file data. By default, this data is transmitted by your browser to the server hosting the respective website whenever you visit a webpage. It includes the following:

7 Legal Bases for Processing

The legal bases for processing are:

• Art. 6(1), first sentence, lit. c and e, in conjunction with para. 3 of the GDPR, in conjunction with

• Section 4, Permissibility of the Processing of Personal Data, of the Baden-Württemberg State Data Protection Act, in conjunction with

• Section 2, Tasks, Paragraph 9, of the Baden-Württemberg State Higher Education Act.

The legal basis for processing your data when you consent via the cookie consent tool to statistical analysis using Matomo and to the use of social media on our website is your consent pursuant to Art. 6(1)(a) of the GDPR.

The legal basis for processing data that you yourself make publicly available on our social media channels through posts and comments is Article 6(1)(a) and (b) of the GDPR in conjunction with Section 19a (Right of Public Disclosure) of the German Copyright Act (UrhG).

Data processing in connection with subscribing to and receiving the Research and Transfer newsletter is based on your consent pursuant to Article 6(1)(a) of the GDPR, which you have provided to us by voluntarily subscribing to this newsletter and by consenting to the use of Google reCAPTCHA. We require Google reCAPTCHA to protect the email service from spam submissions. We process the record of your consent in accordance with Article 6(1)(c) and (3)(a) of the GDPR. If you do not wish to consent to data processing for newsletter registration, you can also access issues of the newsletter via our website.

In the event of unlawful conduct by our organization—including in relation to this website, our social media channels, and/or legal disputes concerning our social media accounts—the legal basis is Article 6(1), first sentence, (c), as well as Article 17(3)( b) and (e) of the GDPR.

 

8 Recipients of Personal Data

The recipients of the data are, first and foremost, the employees of PH Weingarten who are entrusted with processing the data for the specified purposes or who are involved in matters related thereto. This also applies to data that you provide to us, for example, when contacting us via email or telephone.

The respective operators of the social media platforms LinkedIn, Facebook (Meta), Instagram (Meta), and YouTube (Google) are also recipients of the data, acting in joint responsibility with us.

 

9 Transfer of Data to a Third Country

PH Weingarten does not actively transfer any data to a third country. However, the provision of social media channels—with the exception of our Mastodon channel—is carried out under joint responsibility with the respective platform operators and thus includes the data processing and, where applicable, data transfers performed by them. Under the Data Privacy Framework, the EU has issued a so-called “adequacy decision” regarding the level of data protection in the United States. The platform operators Google (YouTube, reCAPTCHA), LinkedIn, and Meta (Facebook, Instagram) have registered with the U.S. Department of Commerce in accordance with the requirements.

 

10 Duration of Data Processing

We process the data for as long as the purposes and legal bases listed above remain valid. The duration of data processing by Google, LinkedIn, and Meta is specified in the respective privacy policies of these platform operators.

 

11 Obligations to Provide Your Data to PH Weingarten and Consequences of Non-Provision

For technical and legal reasons, it is not possible to prevent the processing of the data transmitted by your browser to the PH Weingarten website host each time you visit this website—it is not possible to access the website without this data processing.

Furthermore, the information on this website can be accessed without providing any additional personal data. This also applies to our Mastodon channel.

If you wish to subscribe to the newsletter on research and knowledge transfer, we must process the relevant data; otherwise, the spam protection for the registration form and the subsequent distribution of the newsletter would not be possible.

If you wish to use our social media channels on LinkedIn, Facebook (Meta), Instagram (Meta), and YouTube (Google) (including when you click on one of the videos embedded on our site), additional data processing will be carried out by these platforms, over which we have no control.

If you would like to interact with us via social media but do not wish to have your data processed by LinkedIn, Facebook (Meta), Instagram (Meta), and YouTube (Google), we recommend contacting us through our Mastodon channel.

13 Your Rights

You have the right to request information from us regarding the data we have stored about you in accordance with the provisions of Article 15 of the GDPR (subject to any restrictions under Section 9 of the Baden-Württemberg Data Protection Act (LDSG)).

Upon your request, we will rectify the data we have stored about you in accordance with Article 16 of the GDPR if it is inaccurate or incorrect.

If you so desire, we will erase your data in accordance with the principles of Article 17 of the GDPR, provided that no other legal provisions (e.g., statutory retention obligations or the restrictions under Section 10 of the Baden-Württemberg Data Protection Act (LDSG)) or an overriding interest on our part (e.g., to defend our rights and claims) preclude this.

Subject to the conditions set forth in Article 18 of the GDPR, you may request that we restrict the processing of your data.

Furthermore, you may object to the processing of your data pursuant to Article 21 of the GDPR, in which case we must cease processing your data. However, this right to object applies only under specific circumstances related to your personal situation, and our company’s rights may, in some cases, override your right to object.

You also have the right, under the conditions set forth in Article 20 of the GDPR, to receive your data in a structured, commonly used, and machine-readable format or to transmit it to a third party.
